Who owns the code and the data?
You do. The system runs on your server or ours, whichever you choose. The source code, database and access credentials are handed over to you.
Why is a custom CRM better than HubSpot, Pipedrive or Bitrix24?
It is not always better. An off-the-shelf service wins when sales are standard and the team is small.
